TOWN OF NEW DENMARK

MINUTES FROM MONTHLY MEETING

MARCH 7, 2011

 The regular monthly meeting for the Town of New Denmark was called to order on Monday, March 7, 2011 at 7:00 p.m. by Chairman Bill Krueger.  After the Pledge of Allegiance the Minutes from February’s regular monthly meeting were read and a motion was made by Sup. Goetsch to amend Minutes to remove June 1, 2011 date from razing of Bruflat property and clarify property “will be removed upon transfer of title.”  Seconded by Sup. Rabas to approve with revision.  MC

 MINUTES FROM SPECIAL MEETINGS:  None

TREASURER’S REPORT:  As of February 28, 2011,the Treasurer’s books show a balance on hand of $691,818.81, in the money market and $39,718.83 in checking.  Treasurer states February Settlement noted at bottom of report.  Motion made by Sup. Goetsch and seconded by Sup. Rabas to accept report. MC

COMMENTS and CONCERNS FOR THE PUBLIC:  Kathy Janssen of 6333 Rosecrans Rd inquires how the State’s proposal to eliminate the recycling grant will affect the Town and residential cost as she would like to see the recycling efforts continue.

OLD BUSINESS:  Zoning Administrator Position still on the table but Sup. Goetsch does not want to continuously delay and wait for the Town of Scott.  Motion by Sup. Rabas and seconded by Sup. Goetsch to table.  MC   Designate Brown County Bridge Fund for 2011:  Clerk states she spoke with Brian Lamers and funds designate actually apply to the next year.  Thus, the $30,000 designated last year applies to 2011 and was not matched by County but levied in the Town budget with road funds.  Discussion of proposed Bridge projects for 2011.  Bridge on Cooperstown Rd to be inspected this Spring.  Motion by Sup. Rabas and seconded by Sup. Goetsch to designate $0 for 2011.  MC

NEW BUSINESS

ZONING AS TO PARCEL ND-427 (C. SCHROEDER):  Parcel has appropriate road frontage.  Plan Commission recommended 6-1 to accept as grandfathered parcel in existence prior to 1974.  Motion by Sup. Goetsch and seconded by Sup. Rabas to accept for single family home with DNR requirements and setbacks met per Code. MC

APPROVE INFORMATIONAL BUILDING & CULVERT PERMITS:   Informational Permit for single family home for C. Schroeder for ND-427 (5737 Cty Hwy T) approved with above conditions.  MC   Informational permit for T. Downing for ND-72-1-1 Fenwick Lane for single family home.  Motion by Sup. Rabas to approve with setbacks approved by building inspector.  Seconded by Sup. Goetsch. MC

OVERVIEW OF ANNUAL REVIEW w/ Virginia Hinz at Schenk: Performed review, not formal audit with filing of State CT form.  The Town maintains a healthy fund balance, which should be around 15-20% of budgeted expenditures.  Historically the Town was allowed a 3% levy increase or growth.  Typical levy around $440,000 for the last few years using the fund balance to offset expenditures.  Town has historically budgeted around $800,000 and used $650,000 to $700,000 so the Bd is left with some room to reduce expenditures.  In addition, should the Town need to budget for larger projects, debt can be added without affecting the levy limit. 

ASSESSOR’S REPORT:   Gary Taicher states he is reviewing land sales.  Next meeting to look at Board of Review dates in May. 

UPDATE ON LEGAL ACTIONS:   Atty. Alex Sickel present and provides legal update as to Court ruling on Berger claims.  Eastwind Drive has been declared a legal/dedicated road by the Court but this would not preclude the Town from taking action to vacate. Town’s Motion to Dismiss regarding parcel size and whether the Bd considered the appropriate factors when denying rezoning remains pending.     Sup. Goetsch questions if there is any reason not to consider Eastwind Drive for vacation as it was originally one of the roads on the list submitted to the Plan Commission to consider.  At this time, Atty. Sickel states the Town could proceed.  As to Mischler/Bruflat properties Atty. Sickel is waiting for a response or evidence property has been obtained.

ROAD AND BRIDGE REPORT:  Sup. Rabas presents options for 911 fire sign updates regarding 8x20” vs 8x16”signs.  Cost estimated to be $770 more for larger signs.  Cost includes material, removal of old signs and installation of new signs.  Lange Enterprise estimates cost at $14,265 for total project.  Upgrades need to be completed by 2012. Motion by Sup. Goetsch and seconded by Sup. Rabas to proceed with bid from Lange Enterprise to update 911 signs.  MC  Mark Schlies has been issued 5847 Ronk Road as a fire number for ND-415.  Sup. Rabas states weight limits should be posted on Town roads by next week.  He will make the necessary call to have roads posted.  Sup. Goetsch questions what actions should be taken regarding dumping which was raised last month.  Sup. Rabas has a sign available and will post it by N. Town Hall Road as this seems to be frequently utilized as a dumping site. 

UPCOMING MEETING DATES: Sup. Goetsch inquires as to when the Spring road tour should be conducted.  A few complaints last year that it was a little late and too dry.   Mtg date to be selected next month.  Plan Commission Meeting scheduled March 22, 2011 at 7 pm to address remaining road vacation and conditional use permit for existing gravel pits.  Sup. Rabas states he will be attending 2011 Wisconsin Towns Association at Whipps on April 2nd.  Annual Town meeting to be held on Tuesday, April 12, 2011 at 7:00 pm

CORRESPONDENCE:  Ltr from American Foods Group read regarding NEW Digester with concerns over reporting requirements which are ambiguous and unclear in the Conditional Use Permit vs  State requirements.  Chairman Krueger nominates Sup. Goetsch to meet with Rob Larsen of NEW to review and discuss the reporting requirements.  Conditions 1 & 3 are okay, 2, 4 & 5 requesting annual reporting vs. quarterly and 5 should be an easy resolution.  Wind Energy info at UW-Oshkosh, Br. Cty Farm Bureau.  Town of Cooperstown hosting water sample testing.  Clerk to post in Newsletter and website for resident participation.

PAYMENT OF BILLS:  Motion by Sup. Goetsch and seconded by Sup. Rabas to pay bills.  MC  Motion by Sup. Goetsch and seconded by Sup. Rabas to adjourn at 8:30 pm  MC
