  1. The regular monthly meeting for the Town of New Denmark was called to order on Monday, December 12, 2011 at 7:00 p.m. by Chairman Bill Krueger. 
  2. After the Pledge of Allegiance;
  3. The Minutes from November’s  regular monthly meeting were read.  Sup. Goetsch clarifies Sup. Rabas stated Information Permit for K&L for intake building should be referred to Plan Commission for review.  #20 – Resolution number corrected to 2011-12.  Motion by Sup. Goetsch and seconded by Sup. Rabas to accept with revisions.  MC
  4. MINUTES FROM SPECIAL MEETINGS: Minutes from special mtg of November 29, 2011 read by Clerk.  Motion by Sup. Goetsch and seconded by Sup. Rabas to accept.  MC
  5. TREASURER’S REPORT:  As of November 30, 2011, the Treasurer’s books show a balance on hand of $400,261.08 in the money market and $37,615.73 in checking.  Motion by Sup. Goetsch and seconded by Sup. Rabas to accept report. MC
  6. COMMENTS and CONCERNS FOR THE PUBLIC:  Michael Vakselis of 5228 Hwy T states he has spoke with Lasees and they are attempting to work out a shared driveway agreement which is fair to both parties.  Unable to reach agreement at this time.  Would oppose vacation of Eastwind Drive until an agreement can be reached.  Roger Stein on behalf of the Village of Denmark would like to work with the Town to look at alternative water sources for the Fire Dept.  Apartment fire last year drained the Village’s water tank within an hour.  Would like to explore options to utilize a retention pond by Krueger property off Hwy R and/or work with Town to build road to possible natural waterway with DNR permits.  Cost to hook up to pipe line exceeds $450,000 in addition to yearly fees and a 4.4 charge per thousand gallons.
  8. APPOINT ZONING ADMINISTRATOR:   Atty Sickel presents proposed contract for Ralph Witte as Zoning Administrator as an independent contractor.  Terms – 1yr with 25-34 hours a month @ $20.00 an hour with mileage reimbursement.  No benefits.  Contract can be terminated without cause upon written notification.  Motion by Sup. Goetsch and seconded by Sup. Rabas to send to Mr. Witte.  Position to be effective January 1, 2012.  MC 
  9. #2011-11   RESOLUTION TO VACATE EASTWIND DRIVE:  Sup. Goetsch does not have any objection to tabling and does not want to force Vakselis to install new driveway.  In addition, mound system creates an issue as to where a new driveway could be located. Vakselis’ prefer to have shared driveway if it can be worked out.  Motion by Sup. Goetsch to table.  Seconded by Sup. Rabas. MC  Atty. Sickel states new Petition to vacate would need to be approved in order to move forward with future vacation due to time limitations.


10.APPROVE INFORMATIONAL BUILDING & CULVERT PERMITS: Completed informational permit from Fager Homes on behalf of the Woulfs for new home at (ND-587) 5864 Cty Hwy KB.  Monica Ullmer of 6414 Cty Road R for a room addition to the west for 20thCentury Bar.  Motion by Sup. Goetsch and seconded by Sup. Rabas to approve with setbacks reviewed by Norb Buresh. MC

  1. ASSESSOR’S REPORT: Sup. Rabas reports Gary Taicher is on vacation.  Gary reported he has downloaded all the information to the Town computer and will be working with Mr. Buresh on new permits for 2011.
  2. #2011-16 RESOLUTION TO APPOINT ELECTION OFFICIALS FOR 2012/2013:  Resolution read by Town Clerk.  Motion by Sup. Rabas and seconded by Sup. Goetsch to approve. MC
  3. UPDATE ON LEGAL ACTIONS: Berger claim still pending with Court of Appeals. Notice from Brown Cty Treasurer that the taxes for the Bruflat property are now 3 years delinquent.  Property can be acquired by County if not paid.  This poses a problem for the Town if they proceed with Order to Raze.  Cost to raze property could not be recovered through the tax roll.  Clerk presents Notice from County Treasurer to assess $445.00 as a special assessment on ND-18-1 & ND-731-1 for nonconforming septic/mound system.  To be added to January, 2012 Agenda. Atty. Sickel petitioned Judge Warpinski to proceed with Court order to raze Mishcler  property.  Sup. Rabas requests Atty. Sickel perform a title search for Genz property.  Chairman Krueger to personally serve Mr. Cisler with letter to clean-up property within 30 days.
  4. ROAD & BRIDGE REPORT:  Sup. Rabas reports he spoke with Town of Cooperstown and they are requesting formal agreement as to split of bordering roads so it is clearly noted.  Town of New Denmark to maintain Cooperstown from NN to Cedar Creek (2.43 miles) and Town of Cooperstown to maintain Cedar Creek to Hwy R.  Paperwork to be drafted for Bds to approve.  Bridges will be shared items.   Bd reviews Town of Cooperstown rates for highway work for 2012.  Similar to Brown Cty.  Motion by Sup. Goetsch and seconded by Sup. Rabas to approve. MC  Chairman Krueger states he looked at culvert on Larsensville and it could use some reinforcing.  Sup. Rabas states he told Kropp to replace.   Sup. Goetsch questions cost and bidding. 

PLAN COMMISSION RECOMMENDATIONS:  None.  Bd questions if request from C. Kafka received regarding property on Hwy R.  Clerk faxed application to rezone, but nothing received.  No Plan Commission meeting for December.

  1. CORRESPONDENCE:  Ltr from Schenk to perform 2011 audit and CT filing at $3,400.  Motion by Sup. Goetsch and seconded by Sup. Rabas to approve. MC  Sup. Goetsch inquires as to Cynthia Paider property with (ND-219) as to compliance and inspection for sanitation system as a mobile home appears to be on property.  Used for hunting purposes only.  Not residential.

PAYMENT OF BILLS:  Motion by Sup. Goetsch and seconded by Sup. Rabas to pay bills. MC

Motion by Sup. Goetsch and seconded by Sup. Rabas to adjourn at 8:25 p.m. MC
