TOWN OF NEW DENMARK

MINUTES FROM MONTHLY MEETING

AUGUST 8, 2011

 

  1. The regular monthly meeting for the Town of New Denmark was called to order on Monday, August 8, 2011 at 7:00 p.m. by Chairman Bill Krueger. 
  2. After the Pledge of Allegiance;
  3. The Minutes from July’s  regular monthly meeting were read.  Sup. Goetsch states in regard to Christensen concern about run-off, Brown County has not responded to Town’s request.   Motion by Sup. Rabas and seconded by Sup. Goetsch to approve with revision. MC
  4. MINUTES FROM SPECIAL MEETINGS: None
  5. TREASURER’S REPORT:  As of July 31, 2011, the Treasurer’s books show a balance on hand of $532,083.15 in the money market and $39,821.86 in checking.  Motion by Sup. Goetsch and seconded by Sup. Rabas to accept report. MC
  6. COMMENTS and CONCERNS FOR THE PUBLIC:  Kathy Christensen of 5188 Langes Corners Road requests speed limit of 35 mph on Langes Corners by railroad tracks.  Submits photos of most recent accident and believes a reduced speed will protect the residents.  Petition with 11 signatures from area residents who support a reduced speed submitted to Bd.  Chairman Krueger states Brown Cty would need to conduct a speed survey and radar monitoring to determine what speed would be appropriate.

OLD BUSINESS: 

7. CUP for Frank Wiltman: Map and abutting property owners noted on application for sand/gravel pit.  Motion by Sup. Goetsch and seconded by Sup. Rabas to accept F. Wiltman CUP.  MC;  No response from Northeast Asphalt due to language of ordinance.  Atty Sickel feels revision necessary to  Sec. B to clarify need to re-apply after expiration of 3 year period.  Motion by Sup. Goetsch to direct Atty. Sickel to modify Chapter 31.06, Sec. B of ordinance to eliminate the need for a new application after expiration of 3 years but any expansion to current operation would require new application.  Seconded by Sup. Rabas.  MC

NEW BUSINESS

8.  APPROVE INFORMATIONAL BUILDING & CULVERT PERMITS: R. Rohr (ND-642) located at 4809 R. Kane Lane for 24’x 24’ pole building.  Motion by Sup. Goetsch and seconded by Sup. Rabas to approve w/ setbacks reviewed. MC  W. Hyduke of (ND-688-1) 5237 Cooperstown Rd for hot water solar storage tank.  Motion by Sup. Rabas and seconded by Sup. Goetsch to approve. MC  R. Larsen 6489 Rosecrans Rd (ND-736) for door and window replacement.  Motion by Sup. Rabas and seconded by Sup. Goetsch to approve with review by inspector.  MC  A. Bradley of (ND-562) for deck addition.  Motion by Sup. Rabas and seconded by Sup. Goetsch to approve with setbacks reviewed by inspector.  MC  M. Heim for an culvert addition on Denmark Rd.  Motion by Sup. Rabas and seconded by Sup. Goetsch to approve.  MC

9.  ASSESSOR’S REPORT:  Gary Taicher reports the Town added just over 1 million in sales for 2010/2011 and 2012 could be a little higher.  Sales holding well in comparison to assessed value which will result in minimal change to the equalized value.  He is also encouraging residents to assist the DNR’s in study/survey regarding the spread of Phragmities grass.

10.  UPDATE ON LEGAL ACTIONSBerger Claim. Atty. Sickel reports a Notice of Appeal to District III Court of Appeals was filed by the Bergers on August 5, 2011.  The Bergers are appealing the Court’s decision on lot size.  The Bergers have petitioned the Town to reconsider the zoning request of ND-176-2 which will be addressed by the Plan Commission on August 16Mischler Property: Mischler has not completed formal application for building permit and deed was not recorded to transfer Bruflat property to his name.  Motion by Sup. Rabas to petition the Court to re-open and proceed with Order to Raze Mischler property.  Seconded by Sup. Goetsch. MC.  New Order to Raze to be commenced for Bruflat property as sale was not consummated.  Atty. Sickel working on revising Zoning ordinance and would recommend a mtg with Aaron Schuette of Brown Cty Planning to discuss proposed revisions at future Plan Commission Mtg. 

11.  ROAD & BRIDGE REPORT:  Speed Limit on Langes Corners Rd:  K. Christensen would like to bring to Bd’s attention 2 vehicles have been totaled in their front yard within the last 6 years.  Chairman Krueger states the County will likely include this statistic when their survey is conducted.  Sup. Goetsch states this stretch of Langes Corners contains a number of residential properties and a reduced speed may be appropriate. Sup. Rabas states 54 loads of gravel have been added to the roads; Northern Concrete has added a new driveway on Cty Hwy R and submits photos of fill that was dumped in right-of-way on Podlasik Lane.  Sup. Rabas questions if letters should be submitted to seek reimbursement for property damage to Park Rd (Pravechek Farms in Kewaunee) and Cooperstown Rd (Leiterman) by farm equipment.    Maribel Rd Culvert Replacement:  Bid specifications submitted to Clerk for posting and publication to replace box culvert.  Sup. Rabas reports Town tractor currently down for repairs as boom was twisted.    Lange Enterprise has begun installation of 911 signs.  Signs to be located on edge of right-of-way and property line pursuant to the State guidelines.

PLAN COMMISSION RECOMMENDATIONS

12.  Recommendation to adopt Resolution to vacate Eastwind Drive:  Minutes from 7/19/2011 Plan Commission meeting highlighted.  Sup. Goetsch is concerned about creating a non-conforming parcel as to the required frontage on Hwy T if Eastwind is vacated and they have not heard from the Lasee’s as to their position regarding vacation.   Sup. Rabas states the purpose to vacate was to save the Town money from future maintenance. Motion by Sup. Rabas to direct Atty. Sickel to draft resolution to vacate Eastwind Drive; seconded by Chairman Krueger.  No further discussion by the Board.  MC 2-1.

13.  Recommendation to adopt Resolution to vacate Neshota Lane (a/k/a Jim’s Lane) and approve CSM for portion to be vacated:  Review of formal CSM as to portion of Neshota Lane to be vacated.  Discussion whether bridge can be barricaded or a load of gravel dumped to restrict access to the old bridge.  Motion by Sup. Goetsch and seconded by Sup. Rabas to direct Atty. Sickel to draft Resolution to vacate a portion of Neshota Lane as reflected on the CSM dated June 17, 2011.  MC 3-0.    The remaining 6 roads will be set forth in Resolutions at the next Town Bd meeting.

14.  CORRESPONDENCE:  None

15.  PAYMENT OF BILLS:  Motion by Sup. Goetsch and seconded by Sup. Rabas to pay bills.

Motion by Sup. Goetsch and seconded by Sup. Rabas to adjourn at 8:45 p.m.  MC
