September 3, 2008 Special Meeting: Updates to Zoning Map

SPECIAL MEETING WITH BROWN COUNTY PLANNING DEPT,
TOWN BD and PLAN COMMISSION
TO UPDATE ZONING MAP

SEPTEMBER 3, 2008 at 6:30 p.m.

A special meeting of the Town Board and Plan Commission was called to order on September 3, 2008 at 6:30 p.m. by Chairman Moore. Present: Aaron Schuette with Brown County Planning Department, Chairman Gary Moore and Supervisor Francis Rabas. Plan Commission: Kathy Janssen, Paul Huguet, Steve Olsen, Keith Brunner, Mike Calewarts, Norbert Hansen, Michelle Wallerius, Clerk and Charles Winnekens, Constable.

Zoning map presented to Town Bd and Plan Commission with proposed changes. Prior zoning map updated in 1985, no parcel lines designated and areas were generalized. Aaron attempted to locate parcels that had homes on 35 acres or more and designated those A-1 Agricultural. For a parcel to be zoned Ag-Residential the parcel must be 1.5 acres and have 200 feet of road frontage. It was determined if a parcel was 3 acres or less and/or had less then 400 feet of road frontage it would be rezoned to Ag-Residential. With these specifications, the parcel could not be split into another buildable site without coming before the Plan Commission for a variance. As parcels are rezoned or changed, these updates can be made immediately by Br Cty. Green area represents the Conservancy District. The outlined area was taken straight from the Comprehensive Plan. Existing homes in the conservancy to be grandfathered-in.

Schlies Lane and Hope Lane have large tracts of land designated Ag-Residential due to the fact there is limited road frontage. Question if salvage area should be identified Industrial by “area” or parcel. Agreed to designate “area” only.

Chairman Moore states he has reviewed prior Minutes in an attempt to locate various zoning changes that were previously approved by the Bd but the majority of the Minutes are vague and ambiguous as to what zoning changes were applicable. To be fair, he would prefer to see changes made across the board for everyone.

Francis Rabas states Eastwind Drive not recognized by Town per prior Town Board Minutes. Never approved. Aaron states he believes a CSM is on file at the County and it is recorded. Francis also states the road has never been improved and per statute if no improvements are made within 20 years it is no longer a Town road. Hettick Road and Joes Lane – also not improved roads.

Question raised about property on westside of Rosecrans where home was removed. Does the zoning remain Ag-Residential? Aaron states it should in good-faith. Air photo map is from 2005. Francis Rabas would like to clarify road names, A. Peterson Lane, Echo Lane moved and re-named to Petersen, Railroad Lane deleted and Frederickson Lane dead ends. Aaron will review land records at County level to see if names were officially changed on the books or just locally.

Chairman Moore states once the map is approved the Town Board can drawn-in new properties as they are added. New air photo be taken in 2010

Aaron will work Francis to update map with correct roads/spelling. Motion by Chairman Moore to approve updated zoning map and refer to Town Board for approval with revisions to road and spellings. Seconded by Mike Calewarts. All ayes. MC

Aaron sates a Class 2 Publication Notice will be required prior to the public hearing. The first publication should run at least 14 days prior and the second at least 7 days prior to the scheduled hearing. Aaron to provide the Clerk with parcel numbers and addresses of parcel affected by the proposed zoning changes. Chairman Moore requests Aaron attend public hearing and invites the Plan Commission to attend also. The map will be available at the Town Hall for review.

Kathy Janssen inquires about re-zoning request from Bel Gioioso Cheese which would affect 14 acres. This is not noted on map, question as to zoning classification, industrial or business district. This parcel to be updated.

Chairman Moore states the Town will also be working with Brown County to update the Zoning Ordinance in an attempt to clarify certain definitions and grey areas. He would also like to see the Town adopt their own subdivision ordinance which would tie in with Brown County’s subdivision ordinance.

Motion by Sup. Rabas and seconded by Norbert Hansen to adjourn at 7:25 p.m. MC
