SPECIAL MEETING of the TOWN BD
SEPTEMBER 28, 2009 at 7:00 p.m.
A special meeting of the Town Board was called to order on Monday, September 28, 2009 at 7:00 p.m. by Chairman Krueger to review and discussion options available to K&L Associates to create a 2 or 3 lot parcel to separate Northern Concrete, residential property and New Organic. Present: Chairman Bill Krueger, Supervisors: Francis Rabas and Matthew Goetsch, Michelle Wallerius, Clerk, Steve Olsen, Constable.
Sup. Rabas states the problem arises because there cannot be two different zonings on lot. Meeting with Town Board, Steve Zeitler, Rob Larsen, Chad Kane and Attorney Jeff Jaekels on behalf of K&L Associates to discuss possible options. First CSM was tabled due to the scale house being located in the easement. That issue has been resolved, as scale house/easement has been moved.
Second problem is that each parcel would need 100 feet of frontage. Rob Larsen states they are requesting this division to make it clean and at the request of the financial institution. Currently they have approximately 4 acres of property zoned commercial. Original CSM which designated this zoning was not recorded with Brown County, but they do pay commercial tax on those 4 acres. K&L would need to go back to the Plan Commission to petition for additional commercial property since the frontage can not be taken from the Ag-residential zoning. Lot 2 – NEW Organic (Digester) and Lot 1 – would be designated for Northern Concrete – currently this is one tax parcel. Balance of acreage remains with house and barn as Ag.
Rob states the house and barn is not a concern for them. They wish to have the two commercial parcels separate, but this creates a 3 lot CSM with parcel under 10 acres and to be recorded each lot would need adequate frontage – easement to NEW Organic would not be sufficient for County’s standards and would need to work with the 4 acres available to them. Road frontage is not available (116 plus 60). Could petition Board of Appeals for a variance to as to frontage or would need to seek a rezoning of AG property to be zoned Commercial so CSM can be properly drafted. K&L would prefer to have 3 lot CSM as it is cleaner and preferable for the bank.
Will submit re-zoning request and fee with Clerk in order to proceed with new CSM.
