PLAN COMMISSION MEETING
SEPTEMBER 28, 2009 @ 7:30 P.M.
Members Present: Chairman William Krueger, Kathy Janssen, Paul Huguet, Keith Brunner, Francis Rabas, Norbert Hansen, Steve Olsen, Michelle Wallerius, Clerk.
The Plan Commission meeting was called to order by Chairman Bill Krueger at 7:45 p.m. to address the following:
REZONING REQUEST OF P&D REAL ESTATE LEASING, INC. (NORBS SALVAGE): Corrigans, CBS submits a rezoning application on behalf of the Novaks to rezone approximately .46 acres from (ND-593-2) Ag-R to (ND-593-1) B-1 as a matter of housekeeping and for the construction of a 4,820 sq. foot pole building. The majority of this property is presently used in conjunction with the auto salvage business has been since the early 90s. The proposed map has been drawn with legal setbacks for the residential property. Sup. Rabas questions what is the advantage to change it? Old fence line was previously used as a boundary, but wanted to make it official. The residential property is left with 10.122 acres.
Motion by Steve Olsen to grant request rezoning petition. Seconded by Paul Huguet. MC unanimously. Individual roll call vote taken:

Second Meeting regarding REZONING REQUEST OF D. Krahn (ND-650): This rezoning request is back before the Plan Commission for a vote regarding the rezoning request of David Krahn to rezone 2 acres from ND-650 from Ag to Ag-R for the construction of a single family home for his son who works on the family farm. Tabled from September 1, 2009 at the request of the Plan Commission for a map which depicts the slope of the property as it pertains to the navigable waterway which runs through the property.
Matt Krahn states the home is situated within the arrows of the slope map and would sit on the edge of the 14% slope. He intends to leave the slope in its present state so a walk out basement can be constructed. As shown on the map, the home is approximately 240 feet from grassy area of the creek.
Kathy Janssen questions how wide is Kane Lane (wide enough for 2 cars to meet)? Francis Rabas believes it is at least a 3 rod road. Ditches dug out in the last few years and it would be difficult to have two cars meet on the road. Three homes are presently situated down R. Kane Lane.
Francis Rabas questions how many days he works on the family farm. Matt Krahn states it varies. He has a full time job outside the farm and handles all the maintenance of the equipment and assists with the spring and fall field work.
Currently the entire parcel is 38.03 cares. Francis Rabas states it is important the Plan Commission remain consistent and take into consideration the ordinances. Plan Commission feels it is important to and beneficial keep the children involved in the community and farming. Francis believes the home site is closer then the required 300 feet from the waterway. Keith Brunner would like to see a more detailed map. Paul Huguet questions if home site falls within the 300 feet of the navigable waterway. Smart Growth also allows for 75 ft setback for an unmapped conservancy. Plan Commission reviews Smart Growth Plan p. 136/137. Kathy Janssen believes this property is unmapped as stated on the map Krahn provided. Francis Rabas believes it goes by the Towns map and it is mapped as a conservancy.

REVIEW OF CSM FOR JOHN VANDERKINTER (ND-87-2): The review of the CSM is before the Plan Commission for a recommendation as to the proposed land division of a grandfathered parcel which is currently owned by Joyce VanderKinter for the construction of a single family home for her son, John VanderKinter. Parcel divided by the railroad tracks and in existence since 1952. Total parcel consists of 27.5 acres. Mr. VanderKinter is requesting approve the new CSM with 3 acres for financing purposes.
Mr. VanderKinter outlines the site of the proposed home on the CSM for the Plan Commission. Norb Buresh reviewed and approved setbacks.
Steve Olsen states the grandfather clause should apply to the whole parcel. Because Mr. VanderKinter is requesting 3 acres for a home site it is appropriate to be before the Plan Commission for review and recommendation. The balance of the land will be retained by his mother, when his father passed away he was gifted the 3 acres.

No public hearing necessary as it was referred to the Plan Commission for a preliminary recommendation before Board approval. To be placed on the Agenda for the next Town Board meeting October 6, 2009 for approval or denial.
