MINUTES FROM MONTHLY MEETING
SEPTEMBER 14, 2009

The regular monthly meeting for the Town of New Denmark was called to order on Monday, September 14, 2009 at 7:04 p.m. by Chairman Bill Krueger. After the Pledge of Allegiance a motion was made by Sup. Goestch and seconded by Rabas to amend the Agenda to reflect “Request to Rezone ND-380 from AG to Ag-R (W. Berger)” shall be amended to reflect correct parcel number ND-176-2. The Minutes from August’s regular monthly meeting were read. A motion was made by Sup. Rabas and seconded by Sup. Goetsch to approve as read. MC

MINUTES FROM SPECIAL MEETINGS: Minutes from August 24, 2009 Plan Commission Mtg read by Clerk.

TREASURER’S REPORT: The Treasurer’s books show a balance on hand of $687,212.21 in the money market and $31,774.51 in checking for a total available balance of $718,986.72. Motion made by Sup. Goetsch and seconded by Sup. Rabas to accept report. MC

COMMENTS and CONCERNS FOR THE PUBLIC: Wayne Hyduke of 5272 Cooperstown Road states he appreciates the new paving on Cooperstown Rd but there are two 3’ x 5’ sections by Bill Schroeder’s driveway that have dips with standing water. Request sections be filled in to prevent problems during the winter. Joe Kobes of 5965 S County Hwy T states he would like to see the Town relocate Petersen Lane as the current road goes through the Nelsen property and a new well has been installed. The home is 10 ft from the road and they have small children. Mr. Kobes’ children also have property past the Nelsens and would like to see this addressed. Steve Zeitler of 7410 Hidden Valley Rd states he was the surveyor and there is a 70 ft wide dedication that loops around the existing buildings. Petersens reimbursed for the dedication and the Town pd them for this right-of-way. (Sup. Rabas clarifies this statement: Town reimbursed Petersens for cost of survey). Believes the current road could be vacated and relocated per the CSM. Chairman Krueger states he will check into it. Rick Petersen of 5952 Pepper Road owns property to the side and will donate that land to the Town to improve roadway. Jack Denny of 6555 Langes Corners requests clarification on cattle grazing within 10 feet of a conservancy area. Supervisor Goetsch states he is inquiring of the DNR. Chairman Krueger states they will get back to him on that issue. Robert Schiller of 4866 Shirley Road inquires how he can go about replacing his old trailer with newer mobile home. Sup. Rabas does not believe they can increase the size without going through a rezoning process. Trailers are not permitted in the Town. Atty. Sickel states if the footprint is increased it would need to be address through the Plan Commission. Chairman Krueger states he will get back to him on that matter. Sup. Rabas states the property owners of 7435 County X are removing/burning a house and barn without permits. Believes the owners are PTS and Clerk should send letter. Jack Denny states he appreciates the repairs to Langes Corners Rd but no construction signs were installed to warn of the loose gravel and a vehicle flipped this past weekend. Sup. Rabas sates barricades were used. The Town does not have construction signs available to use.

OLD BUSINESS: CSM for K&L Associates: Steve Zeitler requests special meeting of the Town Bd w/ his clients to discuss what options are available to work out the two different zonings for this property. May need to request some type of variance to address these zoning changes. Motion by Sup. Rabas and seconded by Sup. Goetsch to address CSM at a special meeting on September 28, 2009 at 7:00 p.m. MC

NEW BUSINESS

REVIEW AND APPROVE CMS FOR J. VANDER KINTER (ND-87-2): Discussion about whether parcel is still grandfathered if altered with new CSM. Motion by Sup. Goetsch and seconded by Sup. Rabas to refer to the Plan Commission for a preliminary review and recommendation to the Town Bd. MC

APPROVE INFORMATIONAL BUILDING & CULVERT PERMITS: Rick Petersen of 5952 Pepper Road to construct a 40x50 storage building. Motion by Sup. Rabas and seconded by Sup. Goetsch to approve. MC. Driveway/Culvert permit for John VanderKinter for property on Frontier Road. Sup. Rabas reviewed site, no culvert needed – fee to be waived. Motion by Sup. Goetsch and seconded by Sup. Rabas to approve. MC. Karla Kelley of 5657 North Avenue to construct a 14x 20 garden shed. Motion by Sup. Goetsch and seconded by Sup. Rabas to approve. MC. Ken Kafka of 5072 County Rd R for 17’4” x 14’ 9” two story addition (new addition within the required setbacks). Motion by Sup. Goetsch and seconded by Sup. Rabas to approve. MC. Matt/Jill Johnson of 5537 N. Town Hall Road for interior home improvements. Motion by Sup. Goetsch and seconded by Sup. Rabas to approve. MC

ASSESSOR’S REPORT: Gary Taicher states he will begin reviewing sales, viewing and measuring new properties this fall. He presents to the Town Bd old assessment rolls which Bernie Coehn had possession of. Books date back to 1876, 77, 78 and 79. Wayne Hyduke states these may be of interest of the Denmark Historical Society. Sup. Rabas states the entire roll is in the cabinets in the old addition of the Town Hall along with some school records. Gary would also encourage residents to treat and remove phragmites grass if found on their property. Information available at the Town website and in last month’s Newsletter.

REQUEST TO REZONE ND-550 FROM AG TO AG-R (L. Larsen): Request from Lance/Carrie Larsen to rezone 10.24 acres from ND-550 from Ag to Ag-R for the construction of a single family home. Chairman Krueger abstains from proceedings as the property is owned by his brother. Bd members furnished with Minutes from the Plan Commission meeting and Plan Commission recommendations. A Motion is made by Sup. Rabas and seconded by Sup. Goetsch to deny the rezoning request based upon the recommendation of the Plan Commission, the Town’s Smart Growth Plan and ordinances. MC

REQUEST TO REZONE ND-176-2 FROM AG to AG-R (W. Berger): Court ordered remand of rezoning request from Wade Berger to rezone ND-176-2 from Ag to Ag-R for the construction of two single family homes. Clerk provided Bd with letter and attachments dated 9-8-09 which included Minutes from two Plan Commission meetings, packet of materials from the original rezoning request, Court Decision remanding matter back to the Town, individual Plan Commission recommendations, letters from Mr. Berger’s counsel and proposed map and public comments taken prior to the start of the Town Bd meeting. Motion by Sup. Goetsch and seconded by Sup Rabas to deny rezoning request per Town’s ordinance and Plan Commission recommendation. MC

ROAD AND BRIDGE REPORT: Resident request for replacement of speed limit sign on A. Petersen Lane. Discussion who and when sign was placed there and need due to low volume of traffic. Motion by Sup. Rabas to table until Town can make a determination as to what is to be done with this road. Seconded by Sup. Goetesh. MC. Sup. Rabas to contact Dan Drewery at Brown County to see what options exit. Request for Stop Ahead school bus sign on Rosecrans Rd near 6388 property. Sup. Rabas would recommend Dan Drewery review this request and provide Town with options. 45 mph speed limit sign posted in this area. Seconded by Sup. Goetsch. MC

REVIEW & APPROVE HOURLY RATES FOR TOWN OF COOPERSTOWN: Hourly rates for Town of Cooperstown reviewed. Sup. Goetsch questions rates from last year. Cooperstown currently performs small amounts of patching/road work. Sup. Rabas states the rates are close to last year’s rates. Motion by Sup. Goetsch and seconded by Sup. Rabas to approve proposed rates. MC

SET OCTOBER MEETING DATE TO BEGIN DISCUSSIONS ON 2010 BUDGET: Sup. Goetsch attending Sept. 24th Finance workshop. Discussion on new date for Town Bd to meet in October due to conflict with Town’s Association Convention. Regular monthly meeting to be held on Tuesday, October 6th at 7:00 p.m. October 19th established as a working meeting of the Town Bd for the 2010 Budget and October 26th to the public hearing at 7:00 p.m.

CORRESPONDENCE: Ltr from the Dept. of Transportation re: mileage funding. Letter from Atty. Sickel stating ADR has been scheduled with mediator re: Mischler property. Settlement option would be to remove it or repair it up to Code by a certain date.

Milton Bielinski states work on Podlasik Lane will commence tomorrow and would like to have someone available to come out and determine if a culvert is necessary. Ditch may be lower by De Nobles to improve drainage. Sup. Rabas would be available in the afternoon. Also, states new culvert needed to be added to Langes Corners – concrete culvert was cracked and they were unable to utilize. Also inquires if they will obtain more roads from the Town for the 2009/2010 snow plowing season – to be addressed next month. Believes the Town could contract with individuals at a rate less then Town of Cooperstown for work performed. Sup. Goetsch states they only approved the rates; they did not enter into a contract for services.

PAYMENT OF BILLS: Motion by Sup. Goetsch and seconded by Sup. Rabas to approve and pay bills. MC

Motion by Sup. Rabas and seconded by Sup. Goetsch to adjourn at 8:45 p.m. MC
