MINUTES FROM MONTHLY MEETING
OCTOBER 13, 2008
The October regular monthly meeting for the Town of New Denmark was called to order on Monday, October 13, 2008 at 7:00 p.m. by Chairman Gary Moore. After the Pledge of Allegiance the Minutes from September’s regular monthly meeting were read and being two revision by Atty Sickel it should be noted: 50% of assessed value and uninhabitable. Motion by Sup. Bradley and seconded by Sup. Rabas to approve with revisions. MC.
MINUTES FROM SPECIAL MEETINGS None.
TREASURER’S REPORT: The Treasurer’s books show a balance on hand of $460,966.58 in the money market, $9,000 designated to Town Bridge Fund and $1,634.95 in checking. Motion made by Sup. Rabas and seconded by Sup. Bradley to accept report. MC
COMMENTS OR CONCERNS FROM THE PUBLIC:
Ed Larsen of 5274 Park Road requests permission to remove Baeten Road sign by the end of his driveway. Sup. Rabas to remove. Frank Wiltman of 5176 Larsen Road questions why the Town was required to publish the large notice for the zoning map. Chairman Moore states it was mandated by the State and notice had to be provided to all properties affected by proposed zoning change. Bob Larsen of 5226 Larsenville Road inquires about the map. Chairman Moore states a public hearing will be held. Residents are invited to look at the map at the conclusion of meeting tonight. Ed Larsen questions if the zoning change will affect the taxes. Chairman Moore states no, all it does is add a color to the Town zoning map.
OLD BUSINESS: Stop Sign at Langes Corner and Steve Cheese Road: Sup. Rabas states he spoke with Dan Dheury and Brown Cty would not recommend removing stop sign on Langes Corner as it would open up the thoroughfare and increase speed. Children at Play Sign: Brown Cty no longer installs these signs as it puts liability on the Town or County by acknowledging a potential problem. It is the parents’ responsibility to control their children. Dilapidated Buildings: Report of Norb Buresh reviewed. ND-100: Old School House located off Pine Grove and Cty Hwy NN. Only remaining structure is brick walls. Building assessed at $1,500. Estimated cost of repair: $85,000. ND-17-1: 4712 County Hwy P – Property damaged by fire: Assessed value $25,400; Estimated cost of repair: $52,000 and property does not conform to current setbacks. ND-18-1: 4706 County Hwy P. Assessed value $43,700. Building inspector reports building should be razed, uninhabitable, unsafe and cost to repair would exceed 50% of value. Atty Sickel states the Town would need to pass resolution to raze (Clerk to draft) and Atty Sickel to send notice to property owners. Motion by Sup. Rabas and seconded by Sup. Bradley to table until next month in order for Resolutions to be drafted. MC
NEW BUSINESS
RURAL INSURANCE: Kevin Schommer of Rural Ins. reviews liability and work comp policies. Review of building, personal property, tractor and accessory values. Suggestion to depreciate tractor and mower attachments. WC policy regulated by State. New invoice to be provided to Clerk with adjustments made to tractor and attachments. Motion by Sup. Bradley and seconded by Sup. Rabas to approve policies with adjustments to tractor and mowers. MC.
CONNOR LANE
Atty Pollen submits letter as to Notice of Claim by Mr. Wery. Sees no merit to any of the claims. Two options: Deny claim by Resolution which would require Wery to file a civil action within 60 days or ignore and allow the 3 year statute of limitations to run. Title search shows the Town owns more of Connor Lane then the CSM designates because it was not properly vacated. Atty Sickel would recommend correcting this through proper vacation of highlighted section of Connor Lane. Property would revert back to Wery/VandenBush. Atty. Sickel would also suggest Wery and VandenBush discuss possible conveyance of property in an attempt to negotiate a resolution. Connor Lane cannot be vacated because it would contradict the required 200 feet of road frontage. Atty Pollen would recommend Bd take no action at this time and allow statute of limitations to run so Mr. Wery’s hand is not forced to file a civil action prematurely which would only incur additional legal costs for both sides. Motion by Sup. Rabas and seconded by Sup. Bradley to take no action on Notice of Claim. MC
CODE OF ORDINANCES
Atty Sickel reports his review of the Code is 2/3’s complete. 44 Chapters and each Chapter includes references to statutes which must be crossed checked and/or updated. Many ordinances need input or recommendations from the Bd or Ordinance Committee in finalize the ordinance. Will have draft back to the Bd by November 10th meeting.
ROAD CLASSIFICATION – PODLASIK LANE
Additional questions have arose as to proper width of road. Mr. Bretton states the Town’s zoning map shows the entire portion of Podlasik Lane as a Town road. Chairman Moore still reviewing records and has a concern the road would need to upgraded/widened and ditches added to met specification. Will need to discuss/review further before decision can be made.
CSM – ALAN VANDERKINTER
CSM which creates Lot 1 with residence from 40 acre parcel. Sup Rabas questions width of road and believes it should be extended to 70 ft. Question as to need for CSM. Property owners are refinancing and wish to have home designated with 5 acres. Bd states if approved, the parcel cannot accommodate another home. Motion by Sup. Rabas and seconded by Sup. Bradley to table until next month to clarify width of roadway. MC Chairman Moore questions who will follow up on question. Sup. Rabas will make necessary calls to clarify road width.
SEXUAL OFFENDER LAW ENFORCEMENT & NEIGHBORHOOD WATCH COMMITTEE ORDINANCE: Chairman Moore questions Neighborhood Watch Committee aspect of ordinance and would like further clarification. Motion by Sup. Rabas and seconded by Sup. Bradley to table until next month. MC Atty. Sickel states the Bd can have two types of ordinances: 1) That disallows individuals from being within 300 feet from activities of children (educational, recreational) or 2) Restricted from residing within 1,500 feet from where children gather.
ASSESSOR’S REPORT: Gary Taicher reports he has been working on updating sales and does not anticipate much of a change in values. Will be attending Assessor training on November 10th. Equalization values should be close to 2007. Gary will follow up with Assessment Technology for renewal of Market Drive program. 2007 rate: $.50 per parcel.
TOWN ROAD & BRIDGE REPORT: Sup. Rabas inquires about driveway added on Kane Lane, as a culvert will need to be added. Also raises concern about road signs being hit by paint balls on North Avenue & Ronk Road. Inquires if the Town should put notice in paper for reward as to who is responsible. Issue of tires and mattresses being dumped in right-of-ways. North Avenue culvert has not yet been back filled and an area near Maribel/Park Road sank. Will review next spring. Chairman Moore extends a thank you to Sup. Bradley and Rabas for their diligent work on maintaining and up keeping the roads. Their work is done efficiently and cost effectively.
VIKING RESCUE SQUAD UPDATE: Village of Denmark did not renew with Viking and will seek bids from other municipalities for an improved service. The Village felt Viking did not address the concerns previously raised. The Town has a duty to provide ambulance and fire protection service to the residents in the most cost effective manner.
VOTE ON RENEWAL OF VIKING RESCUE CONTRACT FOR 2009: Rates submitted by Viking Rescue will be adjusted with the Village looking at other options. New Denmark is the 2nd largest municipality and located closest to services. The Fire Dept is in the process of organizing First Responders to address the immediate problem. Viking response times have not always been valid or at best questionable. Motion by Sup. Bradley to schedule meeting with County Rescue to have contract negotiations with the Village of Denmark and request adjusted per capita rates from Viking with the Village removed from the equation. Seconded by Sup. Rabas. MC
SET PUBLIC HEARING DATE FOR 2009 BUDGET MEETING: October 27, 2008 at 6:30 p.m. public hearing to discuss 2009 proposed budget.
APPROVAL OF INFORMATIONAL BUILDING PERMITS: Mike Seidl located at Langes Corners Road to construct 98x220 barn. New addition included with reconstruction of barn damaged by the fire. Motion by Sup. Bradley and seconded by Sup. Rabas to approve with approved setbacks. MC Larsen Angus Farms: Request to construct calving barn with maximum capacity of 700 animals. Larsen has applied to Brown Cty for Livestock Siting Plan. Town also adopted Livestock Siting Ordinance in 2006 for any facility that may contain 500 plus units. Ordinance to be located by Clerk and provided to John Larsen. Motion by Sup. Bradley to approve contingent upon the submittal and application of Livestock Siting Specs to the Town and Brown Cty. Seconded by Sup. Rabas. MC Chairman Moore questions illegal building which was put up by Joe Nemetz on Park Road. Motion by Sup. Rabas and seconded by Sup. Bradley to issue citation to property owner and appear in municipal court. MC
CORRESPONDENCE: Map of 2009 ATC transmission wires available for review. Ron DeGrand provides update to Br County Plan Commission meetings held to date. County has $400,000 dollars in grant money available for clean up of hazardous substances. Environmental Impact Study complete.
PAYMENT OF BILLS: Motion by Sup. Bradley and seconded by Sup. Rabas to approve and pay bills. MC
