March 26, 2009 Special Town Board Meeting to Discuss Zoning Code Updates

SPECIAL MEETING WITH BROWN COUNTY PLANNING DEPT,
And TOWN BD TO UPDATE ZONING CODE

MARCH 26, 2009 at 6:00 p.m.

A special meeting of the Town Board was called to order on March 26, 2009 at 6:00 p.m. by Chairman Moore. Present: Aaron Schuette with Brown County Planning Department, Chairman Gary Moore and Supervisors: Francis Rabas and Richard Bradley, Michelle Wallerius, Clerk and Charles Winnekens, Constable.

Aaron Schuette reviewed the current Zoning Code at the request of the Town Board to correct and align the code with the Town’s Comprehensive Plan and the new Code of Ordinances. Aaron provides a handout as to possible changes or recommendations. The current Zoning Code is not in bad shape and is a solid ordinance. Good base to work from. Problems to address from current Zoning Code: p. 3, 20, 21, 47, 48, 68, 78 & 82.

Page 3 – include updated Town Comprehensive Plan; Page 20 – update with new zoning map; Page 21 – Tower section to be removed (addressed in new Code of Ordinances); Page 47 – inspection fee of $2.00 removed; Page 48- new revisions to mobile home parks/pre-fab homes; Page 68- Earth Excavation with Non-Metallic to be removed (addressed in new Code of Ordinances); Page 78- outline proper steps to obtain building permit; Page 82 – amendments (should be kept, good to have included).

Street Frontage Issues: Street Frontage clearly defined – continuous to be added or uninterrupted and frontage as it pertains to zoning of a lot – redefined.

Home Occupational Recommendations: Aaron believes this is good to allow and the current Code is very restrictive. Recommends shortening and simplifying this section. Key points: 1) The business is secondary to the home and it cannot change the character of the home. Would recommend adding: 2) Performance Standards – so guidelines of a “home occupation” are defined to the interior of the home.

Signage: Aaron believes a substitution clause is needed to encompass commercial and non-commercial sign print. Non-commercial: Vote for Bill sign, etc. Would add regulation to include R-1 and A-R to be uniform with zoning classifications. Home occupational business signs could not exceed 6 sq. feet. Suggestion to add language which describes procedure to follow in order to add a sign within the Town. Approval of Plan Commission, Town Bd, public hearing, etc. Farm signs of any nature are exempt from these regulations.

Mike Calewarts questions how property is currently surveyed? From the right-of-way or center of road. For the past 10 plus years it was changed from the right-of-way. But the Town does have properties that are surveyed both ways. Some roads are 3 rod roads / 4 rod roads. A Judge has the final authority when ruling on property division.

Chairman Moore suggests next meeting be scheduled with Plan Commission and Appeal Committee to review/discuss proposed changes and receive feedback. May need to review areas if/when the State revises the Farmland Preservation Act – exclusive Ag properties would be affected.
