March 16, 2010 Plan Commission Mtg - Peterson & Zoning Code Updates

PLAN COMMISSION MEETNIG
March 16, 2010 at 7:00 p.m.
A meeting of the Plan Commission was called to order on Tuesday, March 16, 2010 at 7:00 pm. by Chairman Krueger. Present: Chairman William Krueger, Paul Huguet, Kathy Janssen, Steve Olsen, Norbert Hansen, Keith Brunner, Francis Rabas and Michelle Wallerius, Clerk.
CSM for Dennis and Paula Peterson (ND-183-7): CSM submitted which creates Lot 2 with 200 feet of road frontage on Aspen Court. 40 ft sanitary easement shown on Lot 2 for Lot 3 along with easement for shared driveway. Keith Brunner questions if a separate lot is being created 3 lots out of 2. Concern raised over location of sanitary easement no other options available. Chairman Krueger feels it is up to the individual party, not the Plan Commission to decide location of septic system. When property is sold, the parties would need to have septic system inspected and it may fail and location could then be relocated. Question if driveway could be from Hwy T vs. Aspen Court. 30 acre parcel from roadway and concern about navigable stream that cuts through Lot 1. Current zoning is AG-R. Boundary lines being changed and easements for sanitation and driveway established. Concern about shared driveway and sanitary easement. Kathy Janssen not concerned about driveway easement as they approved shared driveway for the church. Steve Olsen inquires how far back the house would be located 500 feet. Dennis Petersen states they have reviewed the Towns ordinance and will comply with ordinance requiring 24 ft right-of-way for emergency vehicles, etc. Voting Sheets distributed and votes read by Chairman Krueger:

4 3 Vote to deny CSM. Public hearing to be held March 30, 2010 at 6:45 p.m.
ZONING ADMINISTRATOR POSITION: Discussion about need for Zoning Administrator. Most, if not all Towns have a Zoning Administrator. Glenmore pays annual salary of $6,000. Morrison pays $7,000 with expenses. Town of Scott incorporates their Zoning Administrator with updating Smart Growth and ordinances more a Town Planner/Administrator and paid hourly. Duties discussed. Prepare and organize zoning requests. Research all Petitions. Discussion whether advertisement should be placed in newspaper and establish interview process. Commission feels person should be a resident of the Town. Paul Huguet, Bill Krueger and Francis Rabas volunteer to put together job description and expectations. Discussion whether to pay per diem or salary. Might be beneficial to pay per diem to start to monitor how much time is put into the position and then adjust accordingly. Building inspector to remain separate position as qualifications and criteria very different.
Motion by Keith Brunner and seconded by Francis Rabas to proceed with appointment of a Zoning Administrator. MC Motion by Francis Rabas to appointment a committee to establish guidelines for job description of Zoning Administrator. Seconded by Keith Brunner. MC.
UPDATES TO THE TOWN ZONING CODE: Preliminary review of Zoning Code to update ordinances. Francis Rabas suggests each person be assigned a section and then work collectively on those proposed changes. Steve Olsen concerned about wind mills. Kathy Janssen feels the Commission could spend a lot of unnecessary time reviewing/discussing this topic when the Town would likely be over ruled by the State. Town has current Wind Energy Ordinance.
Francis Rabas states the Town also needs to establish a fee schedule for the Ordinances to be used with municipal court. Clerk states this was adopted when the Code of Ordinances was established. Francis states Livestock Siting Ordinance needs to be addressed. Discussion to include relevant information that was established in the Subdivision ordinance into Zoning Code such as 150 foot set back from center of road and the 35 acre minimum to be fixed. House for child / farm worker to be reviewed 50% of income from farm operation. Francis states this is a State law which was established by the Farmland Preservation Act. Minimum income is $6,000. Town could establish guidelines that supersede States requirements.

Next meeting scheduled for March 30, 2010 at 7:00 p.m. to review suggestions. Mike Calewarts suggests all zoning requests should be held until changes to the ordinances are complete and adopted. Discussion whether a moratorium would be appropriate while changes are being made and reviewed. Motion by Kathy Janssen Town Board review/discuss possible building moratorium (60-90 days) until ordinances are revised. Seconded by Keith Brunner. MC
