MINUTES FROM MONTHLY MEETING
JUNE 8, 2009

The regular monthly meeting for the Town of New Denmark was called to order on Monday, June 8, 2009 at 7:00 p.m. by Chairman Bill Krueger. After the Pledge of Allegiance the Minutes from May’s regular monthly meeting were read. Supervisor Rabas notes Rice Engineering was the firm that completed the surveying on Old Settlers Road, not Ayres. Motion by Sup. Goetsch and seconded by Sup. Rabas to approve with revision. MC

MINUTES FROM SPECIAL MEETINGS: None
TREASURER’S REPORT: The Treasurer’s books show a balance on hand of $592,754.59 in the money market, $30,037.96 in checking. As of May 31, 2009 total funds available: $622,792.55. Letter from M&I stating all funds fully insured up to $999,999.99. Letter to be placed on file. Motion made by Sup. Goetsch and seconded by Sup. Rabas to accept report. MC

COMMENTS OR CONCERNS FROM THE PUBLIC: Kathy Janssen of 6333 Rosecrans Roads states votes were not taken or carried at last mtg pursuant to Sec. 60.20 of the Wis. Statutes. Prior mtg not conducted by Robert’s Rules of Order. Believes the State of Wisconsin and the residents would prefer the meetings be properly conducted as outlined by the statutes and pursuant to Roberts Rules of Order. Would like to see the buildability of ND-100 sent to the Zoning Commission for review and consideration. Francis Rabas would like to state as a resident/employee of the Town he spoke with Gary Moore on two occasions about the tractor repairs prior to having the repairs made. Gary Moore was to speak with Dick Bradley about the repairs. Not a conflict of interest for a Town Bd member to be an employee of the Town and it was the decision of Dick Bradley and Gary Moore to have him remove the key from the tractor and finish the fall cutting. Gary Taicher of 4408 Pine Grove Road states the hill on the north side of his driveway is sliding down which is backing up water and washing out a portion of the shoulder/road. Similar problem occurred a few years ago. Charles Winnekens states a portion of the shoulder is breaking off from Langes Corner Road, near the curve – from his mailbox to Cty Hwy T. 4 accidents occurred around this curve this past winter.

OLD BUSINESS:
Review Estimates for Repairs to Town Hall Entrances: Sup. Rabas received a bid to repair front entrance for $150. Hinges replaced on door and beveled edge installed by stoop. Sup Rabas will paint board w/ yellow paint. Sup. Rabas believes new hinges would be helpful to secondary entrance and may solve part of the problem with doorway.
Review Estimates for Town Board Identification Cards: Bid received from J. Kralovetz. Cost would be $4.00 per card. Motion by Sup. Goetsch and seconded by Sup. Rabas to proceed with Town ID cards for all Bd members and future candidates that run for Town positions. MC
Buildability of ND-100: No response from Mullins/Benos as to attempt to obtain additional property from adjacent land owners. Building has been razed. Rumble to be cleared. Once removed Atty. Sickel states a release of the lis pendens will need to be executed. Motion by Sup. Goetsch and seconded by Sup. Rabas to table indefinitely as to buildability until approached by property owners. MC
NEW BUSINESS

RESOLUTION TO CHANGE ROAD NAME SPELLING FROM Hajduk to Hyduke: Resolution to affirm spelling of Hyduke Lane read by Clerk. Legal description of road to be added. Motion by Sup. Rabas and seconded by Sup. Goetsch to accept Resolution. MC (Res. #2009-06)

APPROVE CLASS B BEER & LIQUOR LICENSES: Review of beer and liquor licenses. Sup. Rabas believes Twin Oaks will need a second permit to sell beer on beer cart as they are selling outside the “premises” for more then the allowable two days. Circle Tap would have similar issue when they utilize a beer tent for more then 2 days out of the year. Motion by Sup. Rabas and seconded by Sup. Goetsch to approve Class B Beer and Liquor Licenses for: Wise Guys, Basils II and 20th Century. Temporary Class B license to be issued to B-5 (Twin Oaks) and Circle Tap while Atty Sickel researches legal issue. MC

ASSESSOR’S REPORT: Gary Taicher states he will be bring a number of old house plans to the Town Hall for storage. Bd of Review held last month. All documents have been filed with the State. Will be begin work on next year’s roll.

ROAD AND BRIDGE REPORT: Steve’s Cheese Bridge: Pictures taken of condition. Cty recommends bridge be closed or load limits applied. Cty funding available for needed repairs. Sup. Rabas believes a smaller concrete box type culvert could be utilized. Sup. Goetsch suggests cost estimates before proceeding. Ltr to Krahns: Sup. Rabas states a letter was sent to David Krahn on 11-14-08 to clean out breaker run from right-of-way and it still has not been done. Sup. Goetsch recommends sending 2nd notice. Motion by Sup. Rabas and seconded by Sup. Goetsch to send ltr to D. Krahn to remove w/in 30 days or citation to be issued or Town will remove and bill resident for cost. MC North Avenue: Brown Cty Safety Study reviewed. All recommendations have been complied with. Cedars to be trimmed, not cut. Chairman Krueger states he has spoken with Rupps and they are willing to trim the cedars. Motion by Sup. Rabas and seconded by Sup. Goetsch that Clerk send ltr to Rupps to trim cedars within 60 days or Town will trim. MC.

Four separate bids received from Dan Kropp. Podlasik Lane: Ditches to be added on both sides of road. Gezellas will be required to put in culvert. Sup. Rabas suggests dumping fill by guard rails off of Pine Grove into swampy area and rails could be removed. Sup. Goetsch concerned about DNR issues. Kaminski Lane: Replacement of culvert. Blacktop will need to be patched. Ronk Road: dug out and culverts pushed back together. Langes Corners/Koenig: Replacement of two culverts and patch to blacktop required. Sup. Rabas solicited bids from Dave Kasten and Brown Cty but did not receive anything back. Chairman Krueger inquires if bids were requested from Bielinski? Discussion to notify residents of ditch addition on Podlasik Lane. Ltr to be sent to all parties. Sup. Goetsch would like to see additional bids, but if projects to be prioritized – Sup. Rabas would rate 1) Kaminski Lane 2) Denmark/Wanek Road (due to water across road), 3) Ronk – shoulder washed out; 4) Langes Corner culvert. Motion by Sup. Goetsch and seconded by Sup. Rabas to accept Dan Kropp bids for Kaminski Lane and Denmark Road and solicit additional bids from Bielinski and County for remaining projects in order to provide a cost comparison. MC. Sup. Goetsch requests meeting of the Town Bd on June 22, 2009 at 5:30 pm to tour town roads. Clerk to post notice of meeting.

Sup. Rabas states a driveway has been added on Langes Corners Road with no permit. Parcel: ND-275. Motion by Sup. Goetsch and seconded by Sup. Rabas to send ltr to property owner to remove or install culvert within 60 days. MC

Resolution to widen Old Settlers Road to 70 ft read by Sup. Rabas. Motion by Sup Rabas and seconded by Sup. Goetsch to adopt Resolution. MC Town had 90 days from April 13th to have a hrg on resolution and notify adjacent property owners of Resolution. Timeframe has since elapsed.

Trees to be Removed: Motion by Sup. Goetsch and seconded by Sup. Rabas to review and inspect trees during road tour on June 22nd.

REVIEW APPLICANTS FOR SEASONAL GRASS CUTTING: Three applications received. Spencer Schuh @ $14.00 an hr, Frank Wiltman @ $11.75 an hr and Charles Winnekens $12.00 an hr. All applicants have similar experience. Last year cutting and maintenance averaged 300 hours. Motion by Sup. Goetsch and seconded by Sup. Rabas to accept Frank Wiltman’s bid for first cutting and review after first cutting is completed. MC Sup. Rabas would like to see one person do all the cutting in order to monitor the tractor and work product. Proposed timecard submitted.

APPROVE INFORMATIONAL BUIDLING & CULVERT PERMITS: None.

CORRESPONDENCE: Atty. Sickel submits revised Chapter 1 for the Code of Ordinances which reflects the clerk, treasurer and assessor are not appointed but elected to two year terms. Motion by Sup. Goetsch to repeal Chapter 1 of Code of Ordinance and adopt amended Chapter 1.02 to reflect these changes. Seconded by Sup. Rabas. MC

PAYMENT OF BILLS: Motion by Sup. Rabas and seconded by Sup. Goetsch to approve and pay bills. MC

Motion by Sup. Rabas and seconded by Sup. Goetsch to adjourn at 9:00 p.m.
