MINUTES FROM MONTHLY MEETING
JULY 20, 2009
The regular monthly meeting for the Town of New Denmark was called to order on Monday, July 20, 2009 at 7:00 p.m. by Chairman Bill Krueger. After the Pledge of Allegiance the Minutes from June’s regular monthly meeting were read and being no revisions, a motion was made by Sup. Goetsch and seconded by Sup. Rabas to approve. MC
MINUTES FROM SPECIAL MEETINGS: None
TREASURER’S REPORT: The Treasurer’s books show a balance on hand of $569,862.70 in the money market and $32,761.67 in checking. Motion made by Sup. Rabas and seconded by Sup. Goetsch to accept report. MC
OLD BUSINESS
Class B Beer and Liquor Licenses: Ltr from Atty. Sickel reviewed. Chapter 29 governs outside sales and if the parties specifically list the premises for outside sales, a separate license would not be needed. Such as, Twin Oaks would need to list “from a beer cart.” Motion by Sup. Goetsch to approve Class B beer and liquor licenses to Twin Oaks and Circle Tap as long as they adhere to the restrictions outlined in Chapter 29. Seconded by Sup. Rabas. MC A copy of the Ordinance to be furnished to the parties when permanent license is issued.
NEW BUSINESS
ASSESSOR’S REPORT: Gary Taicher reports he has received a few calls from residents inquiring as to property values w/ the downturn in the market. Property values may have fallen slightly but residents need to be aware if a revalue was completed, the mill rate would increase to maintain the current tax base. Some areas have seen a significant decrease in property values, but New Denmark’s sales have held strong compared to assessed values. Gary also would like to bring to the Town’s attention an invasive grass which is growing in the Town – Phragmites. Phragmites can be found along Hwy 41 near Bay Beach. It is very invasive and difficult to control once it takes hold. It could easily spread through the entire river valley and become very problematic and could be a liability to property owners if not controlled. Mr. Hyduke states it has no value to wildlife and takes hold when water recedes from a wetland. Information on how to treat provided. Suggestion to include information in Newsletter and webpage.
PLAN COMMISSION: REMOVE & APPOINT NEW MEMBERS: Chairman Krueger states he received a few calls from concerned citizens about the make-up of the Plan Commission which presently consists of 2 Town Bd members. He feels the appointments should have been made by him as the new Chairman. Sup. Rabas states he intends to fill out his term and requests the names of the residents who complained about sitting members on the Bd. Per State statute the Committees are to be appointed in April. Atty. Sickel states the Plan Commission must consist of the Town Chairman as a presiding member & one additional Bd member & five citizens. Effective April of 2006, Sec. 60.62(4) of the Wis. Statutes allows for removal of a member by majority vote of the Town Bd. The Town’s ordinance still provides a member can only be removed for cause. Atty. Sickel recommends the Town update the Zoning Code to incorporate the new statutory section before making any changes to the Plan Commission. Two alternates should also be named and currently there is one. Chairman Krueger suggests Jocelyn Rupp as an alternate. Sup. Rabas states she removed herself from the Plan Commission and would like to see someone willing to fulfill their obligation. Motion by Sup. Goetsch and seconded by Sup. Rabas to accept volunteers for the open position as alternate. MC Atty. Sickel suggests calling a meeting of the Plan Commission to request the Bd amend the ordinance to reflect the changes in Sec. 60.62(4). Motion by Sup. Goetsch and seconded by Sup. Rabas to send draft changes to Plan Commission. MC
APPEAL COMMITTEE: REMOVE & APPOINT NEW MEMBERS: Same changes recommended for the Appeal Committee. Two alternates also needed and currently the committee has one. Motion by Sup. Goetsch and seconded by Sup. Rabas to accept volunteers to fill one alternate vacancy. MC
ROAD AND BRIDGE REPORT: Park Road Bridge construction was to start July 1st. No word from County as to commencement of work. Town Hall Road Bridge: Ayres has received a verbal commitment from DNR. It was suggested to solicit bids this Fall. Steve’s Cheese Road Bridge: Brown Cty provided cost estimate for replacement. Approximate cost to Town would be $20,000 to replace, which includes all permits. 100 yr life expectancy. Motion by Sup. Rabas and 2nd by Sup. Goetsch to accept Item #2 from County’s bid. MC Two missing signs noted and to be replaced on Church/Denmark roads. List of trees to be removed reviewed. Spreadsheet from Brown Cty provided just prior to meeting. List contains Town roads to be abandoned and vacated. Believes there may be a few missing and will review and update list. Atty. Sickel states the process to vacate would be to pass an ordinance and provide notice to all affected property owners. Each ordinance would need to be listed on the Agenda. Hrg to be scheduled. Town would need to adopt individual ordinances for each road, recorded with Register of Deeds and property would revert back adjacent land owners. Town receives just under $2,000 a mile and the roads to be vacated equal 3.4 miles. Spreadsheet reviewed w/ proposed address changes. To be addressed after private driveways have been vacated. Road repairs: Motion by Sup. Goetsch and 2nd by Sup. Rabas to but bids out for road repairs on Pine Grove, Cooperstown, Kaminski, Maribel and North. MC Sup. Rabas to provide Clerk with specific specs. Podlasik Lane: Ditching to be only completed on the west side of the road. Bids reviewed from Kropp and Bielinski. Kropp’s bid contains both ditches and is not a fair estimate. Bielinski’s bid is for all six projects combined. Discussion to allow Kropp to amend his bid. Milton Bielinski states his bid is for all six projects as total package. Motion by Sup. Goetsch to accept Bielinski’s bid for all six projects. Seconded by Sup. Rabas. MC Repairs to commence next week.
APPROVE INFORMATIONAL BUILDING & CULVERT PERMITS: Julie Lane of 6003 Hwy KB to construct 20x20 garden shed. Motion by Sup. Rabas and seconded by Sup. Goetsch to accept with approved set backs. MC; K&L Associates (3) permits for a 12x14 addition to existing shop; new silo roof to existing barn and 38x16 addition; and 20x16 scale house. No drawings attached. Clerk to return for more information. Randy/Dori Kropp of 4786 Langes Corner Road to construct 24x30 addition to existing outbuilding. Motion by Sup. Goetsch and seconded by Sup. Rabas to accept with approved setbacks. MC; Don/Mary Nowak to construct a 16x40 storage building. No drawing included. Clerk to return for more information. Brian Christman of 5027 Cherney Road for 2nd floor remodeling project. Motion by Sup. Goetsch and seconded by Sup. Rabas to accept. MC Darryl Sorenson of Lot 2 – Hwy R to construct a single family home. Motion by Sup. Goetsch to approve. No second. Sup. Rabas believes the Town adopted an ordinance which sets a maximum distance the home could be set back and he believes they exceed this. Unable to locate ordinance. Tabled until next month’s meeting. Wayne Hyduke of 5237 Cooperstown Rd to construct a 14x15 solar array. Setbacks already approved by Norb. Motion by Sup. Rabas and seconded by Sup. Goetsch to accept. MC Ken VandenElzen of 5201 Cty Rd NN to construct a 90x120 riding stable. Map attached. Motion to by Sup. Goetsch and seconded by Sup. Rabas to table for specific setbacks. MC 2 Culvert permits for D. Schlies. Motion by Sup. Goetsch and seconded by Sup. Rabas to approve. MC. K&L Associates to move existing driveway 100 ft. Motion by Sup. Goetsch and seconded by Sup. Rabas to approve. MC
CORRESPONDENCE: None
COMMENTS OR CONCERNS FROM THE PUBLIC: Wayne Hyduke recommends the Town contact Brown Cty Extension to obtain information about Phragmites and include for Town residents. Also raises concern about Brown County imposing advisory recommendation upon the Town such as changing addresses. Believes this is the Town’s responsibility. Hyduke lane is not listed on rescue squad maps. Town gov’t is the last freedom for a resident to express themselves and feels this should be preserved. Kathy Janssen states the zebra sign is missing near the guardrail on Rosecrans. Gary Moore of 5526 N. Town Hall Road recommends the Plan Commission make revisions to Chapter 19 and also finalize proposed changes discussed in March. Also would like to see the Bd acknowledge Dick Bradley’s service to the Town for 27 years. Also it is a great injustice to have Comments and Concerns at the conclusion of the Agenda and believes most towns allow these at the beginning of the meeting. Milton Bielinski states there will be an increase in snow plowing rates due to salt prices. Charlie Winnekens requests update on grass cutting. Joe Kobes of 5965 S Cty Hwy T inquires as to the height a tree stump when cut. Also many large stones are in the ditch and should be removed.
PAYMENT OF BILLS: Motion by Sup. Goetsch and seconded by Sup. Rabas to approve and pay bills. MC
