MINUTES FROM MONTHLY MEETING
DECEMBER 8, 2008

The December regular monthly meeting for the Town of New Denmark was called to order on Monday, December 8, 2008 at 7:00 p.m. by Chairman Gary Moore. After the Pledge of Allegiance the Minutes from November’s regular monthly meeting were read and being no revisions a motion was made by Sup. Bradley and seconded by Sup. Rabas to approve. MC.

MINUTES FROM SPECIAL MEETINGS: None

TREASURER’S REPORT: The Treasurer’s books show a balance on hand of $476,366.07 in the money market, $9,000 designated to Town Bridge Fund and $2,185.99 in checking. Motion made by Sup. Rabas and seconded by Sup. Bradley to accept report. MC

COMMENTS OR CONCERNS FROM THE PUBLIC: None

OLD BUSINESS: Zoning Map received from Brown County Planning Dept. Clerk to sign and date map. Viking/County Rescue services will increase to $9.67 per resident. Sexual Offender/Residency Restriction Ordinance: proposed draft reviewed which combines both restriction as to residency and prohibits offenders from being in places were children gather with exemptions listed. Ordinance to be added to Code and will be reviewed in detail at the public hearing on December 18th.

NEW BUSINESS

SCHENCK – ANNUAL REVIEW: Clerk provides options for Annual Review and filing of State CT form. Motion by Sup. Rabas and seconded by Sup. Bradley to approve Annual Review for 2008 for total cost of $3,100. MC

RESOLUTION FOR CONDUIT BOND: Lynda Templen not present. Motion by Sup. Rabas and seconded by Sup. Bradley to table until next month for further explanation of bond process. MC

TOWN HALL ENTRANCE: Resident tripped on front entrance stoop on November 4th election. Kevin Schommer of Rural Insurance advised doorway must be less then ˝ inch in height. Discussion if repairs can wait until Spring as concrete steps would need to be replaced, not practical to proceed at this time. Atty. Sickel recommends entrance be closed. Repairs to be addressed in Spring and alternative entrance to be utilized until further notice.

DESIGNATE NEWSPAPER FOR TOWN PUBLICATIONS: Discussion as to which newspaper should be used for future publications of legal notices with the closing of the Denmark Press. Unofficial discussion that Algoma may be taking over local publication. Sup. Rabas states the Town does not need to designate an official newspaper. Clerk clarifies this is only to designate a paper to publish future legal notice that are required per State statute. Motion by Sup. Bradley and seconded by Sup. Rabas to utilize the Green Bay Press Gazette until a local newspaper is established. MC

Atty. Sickel states resolutions to raze buildings approved in November need to be revised after title searches disclosed some discrepancies in the legal descriptions. Once approved, resolutions will be recorded with the Register of Deeds. Revisions needed to eliminate confusion with neighboring properties. Revised resolutions have been amended with the proper legal description and a 60 day time period inserted from the date service is effectuated to comply with Order.

REVISED RESOLUTION TO RAZE BUILDING – ND-17-1 (4712 CTH P): Motion by Sup. Bradley and seconded by Sup. Rabas to approve revised Resolution to Raze ND-17-1 with revised language and proper legal description. MC. Clerk designates #2008-09-01 for Resolution.

REVISED RESOLUTION TO RAZE BUILDING – ND-18-1 (4706 CTH P): Motion by Sup. Rabas and seconded by Sup. Bradley to approve revised Resolution to raze ND-18-1 with revised language and proper legal description. MC. Clerk designates #2008-08-01 for Resolution.

REVISED RESOLUTION TO RAZE BUILDING – ND-100 (School House): Motion by Sup. Rabas and seconded by Sup. Bradley to approve revised Resolution to Raze ND-100 with revised language and proper legal description. MC Clerk designates #2008-10-01 for Resolution.

ROAD AND BRIDGE REPORT: Ayres in process of completing Phase I of bid for W. Town Hall Road bridge. No report received yet. Minor issues with snow plowing thus far. Sup. Rabas states he believes there may be some funds available from the State for road and bridge repairs. Chairman Moore reads letter from WI DOT requesting bridge plans which contain structural ratings for all local bridges. Bd does not believe the Town has any bridge plans on file that provide structural ratings. Question raised if Brown Cty has submitted their bridge report? Sup. Bradley believes this is conducted in the winter when waterways are frozen and they can visually inspect the bridge from underneath. Chairman Moore states the road fund is limited and roads may be snow covered. Residents are encouraged to slow down and drive the conditions.

VIKING RESCUE UPDATE: Proposed new rate addressed above.

REVIEW AND REVISE 2009 BUDGET – LEVY LIMITS: Clerk states in preparing the Levy Limit worksheet for the State she discovered an error with the approved 2009 Budget. The Town exceeds the allowable 2% levy limit for 2009 and is at risk of losing all State funding. In order to preserve all available funds, the Town must designate $141,200 to the General Reserve Fund to comply with the State imposed levy limit of 2%. Motion by Sup. Rabas and seconded by Sup. Bradley to revise the amount designated in the General Reserve Fund to $141,200 for the 2009 Budget. MC

2008 TAX ROLL: 2008 mill rate worksheet provided. Mill rate total is 16.337.

APPROVAL OF INFORMATIONAL BUILDING PERMIT FORMS: Ltr from Seidl Livestock and Norb Buresh revising the barn addition to 72’ x 145’ and stating they will abandon previous building request. Information Building Permit Form submitted by Mike Seidl to construct 26’ x 42’ office building east of the barn. Permit does not specify location for building. No map or drawing. Motion by Sup. Bradley and seconded by Sup. Rabas to put on hold until more info is received as to exact location. MC

CORRESPONDENCE: Ltr from UW Extension re: noxious weeds in Br Cty and location where the weeds were removed. Bd questions donation to Invasive Species project in 2007 - $160.00. Motion by Sup. Bradley and seconded Sup. Rabas to donate $70.00 to Invasive Species fund for 2008. MC

Sup. Rabas provides update to VFW War Veterans Memorial Park in Denmark. The eves have been covered and carpet replaced. Village questioned why they pay the maintenance of the shelter house. Sup. Rabas states the Minutes provide that the Village would assume this cost. Veterans retain only the rental fee for the shelter house. Food cupboard serving 45 families from Maribel and 70 families from the Denmark area and are always in need of donations.

PAYMENT OF BILLS: Motion by Sup. Rabas and seconded by Sup. Bradley to approve and pay bills. MC

Motion by Sup. Bradley and seconded by Sup. Rabas to adjourn at 8:30 p.m. MC
