August 24, 2009 Town Bd/Plan Commission Mtg to Discuss Zoning Code Updates

SPECIAL MEETING WITH BROWN COUNTY PLANNING DEPT,
TOWN BD and TOWN PLAN COMMISSION TO DISCUSS UPDATES
TO THE TOWN ZONING CODE
AUGUST 24, 2009 at 6:30 p.m.
A special meeting of the Town Board and Plan Commission was called to order on August 24, 2009 at 6:30 p.m. by Chairman Krueger. Present: Aaron Schuette with Brown County Planning, Chairman William Krueger, Supervisor Matthew Goetsch, Michelle Wallerius, Clerk, Plan Commission members: Paul Huguet, Kathy Janssen, Steve Olsen, Norbert Hansen, Michael Gaworek and Keith Brunner.
Aaron Schuette reviews the proposed zoning code changes that were discussed and proposed at the March 26, 2009 town meeting with the former Board. These suggestions are being made to correct and align the code with the Town’s Comprehensive Plan and the new Code of Ordinances.
Required Street Frontage: Current language does not specify frontage has to be contiguous. Definition for contiguous defined as continuous and uninterrupted on one road.
Home Occupations: Aaron believes this is good for the Town to allow home occupations as it is a good for economic development. Definition should be clarified and performance standard added from Town ordinances to define “home occupation.” Key elements: 1) The primary use of the home is to be a “home.” Business usage is secondary and it cannot change the characteristics of the home.
Discussion whether permits for home occupations would be required by the Town. Keith Brunner questions how this could be enforced. Most Towns do not regulate home businesses.
Sign Ordinance: Substitution clause discussed that would encompass commercial and non-commercial sign print. Non-commercial: Town can govern size and location, but not what is printed due to constitutionality of freedom of speech. Steve Olsen questions signage on non-traditional signs, such as a semi trailer. Aarons states it would be up to the Town to enforce this ordinance and what their interpretation would be. LED billboards/round signs/flashing signs would all fall into this category and should be updated to include LED lighting as they could fall into any of these categories.
Aaron states to make these proposed changes, each change would be listed as a separate action item. Plan Commission would recommend proposed changes. Public hearing would need to be held regarding those proposed changes and action by the Town Board to accept or deny. Changes would then need to be published/posted.
Gary Moore of 5523 N. Town Hall addresses that point to point contiguous definition should also be clarified in street frontage. Aaron states this was addressed by defining frontage “along a single street.”
Plan Commission to reconvene on September 22, 2009 at 7:00 p.m. to make recommendation on these proposed changes.
