April 20, 2010 Plan Commission - Zoning Code Updates
TOWN OF NEW DENMARK
PLAN COMMISSION MEETNIG
April 20, 2010 at 7:00 p.m.
A meeting of the Plan Commission was called to order on Tuesday, April 20, 2010 at 7:00 pm. by Chairman Krueger. Present: Chairman William Krueger, Kathy Janssen – designated at Clerk for the meeting, Steve Olsen, Norbert Hansen, Keith Brunner, Francis Rabas, Paul Huguet, Michael Gaworek and Michael Calewarts. Absent: Michelle Wallerius, Clerk.
Continuation of UPDATES TO THE TOWN ZONING CODE:
Maximum Setback from Right-of-way: Discussion re: 35 acre home set back of 150 feet from right of way. Chairman Krueger states he is against that proposal.
Page 7 – #25 add the “contiguous” length
#26 to be re-written pursuant to Francis Rabas’ notes .
#32 to be re-written re: home business
Discussion to have Zoning Administrator issue occupancy permits for new homes.
Article XIII –
Section A - Add Francis Rabas’ notes (See attached).
Section C – Add Ag-R to title and with additions recommended by Aarons Schuette about outdoor lighting to be hooded.
Section E – #1 to include LED lighting and #7 in accordance with Francis Rabas’ notes (Attached).
Section D. – Addition pursuant to Francis Rabas’ notes (Attached).
Discussed high capacity wells – State currently working on legislation. Discussed wind generators and recommended taking photos of roads before construction of such towers.
Article XV – No change
Article XVI: Page 67 - #8 add wording that Performance bond should be based upon the size.
Change wording throughout Code to reference Plan Commission instead of Zone Committee.
Page 68: Section A - #1: Add wording “and shall comply with State and County regulations.”
Article XIX – (Page 74)
Section B: 1, 2, 3 & 4 to be duties of the Building Inspector.
5, 6, 7, 8 & 9 to be duties of the Zoning Administrator.
Discussion of payment for Zoning Administrator. Start candidate search who is a Town resident. Commission recommends fee based salary to start. Town Board will set the amount.
Page 77 – Section D Town Plan Commission: Change order of subpart b to letter (a) and subpart a to (b). Page 78- #4 Membership Subpart b – to include wording and “two alternates.”
Section E Building Permit: #1 to include wording “Town Board, etc., omit “Zoning Administrator and replace with Town Board. #5 – should read “Building Inspector” and not “Zoning Administrator.”
Page 85 – L. Fees: Amount to be changed to: $500 fee for Amendment or Condition Use. The fee for variances and appeals shall be $275.00.
Page 86 – Paragraph 2 shall read “The Building Inspector shall discuss all such violations to the Zoning Administrator, who shall notify the Town Board of such violation . . .”
Paragraph 3 – shall list the forfeiture amount of “no less than $200 nor more then $1,000 plus court courts and/or costs of prosecution.”
